Jampaq Network Terms Of Use:

This Terms Of Use Agreement is effective as of July 29, 2009.

By creating a Jampaq Network user account or using the Jampaq Network service ("Service"), a service of Jampaq, Inc. ("Jampaq"), as a signed in user, you are agreeing to be bound by the following terms and conditions ("Terms of Use").


Basic Terms

1. You must be 13 years or older to use this service. If you are 13 or older but under the age of 18, you should review these terms and conditions with your parent or guardian to make sure that you and your parent or guardian understand these terms and conditions.
2. You are responsible for any activity that occurs under your user name.
3. As a registered user of the Service, you may receive or establish an account ("Account"). You are solely responsible for maintaining the confidentiality and security of your Account and password. You should not reveal your Account information to anyone else or use anyone else's Account. You are entirely responsible for all activities that occur on or through your Account, and you agree to immediately notify Jampaq, Inc. of any unauthorized use of your Account or any other breach of security. Jampaq shall not be responsible for any losses arising out of the unauthorized use of your Account.
4. You must not abuse, harass, threaten, impersonate or intimidate other Service users.
5. You may not use the Service for any illegal or unauthorized purpose. International users agree to comply with all local laws regarding online conduct and acceptable content.
6. You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, profiles, audio and video clips, links ("Content") that you submit, post, and display on the Service.
7. You understand and agree that by submitting or posting any data, text, information, screen names, graphics, photos, profiles, audio and video clips, links ("Content") to the Service, that you grant Jampaq the full and unrestricted permission to post and display that Content on the Service, including, but not limited to on your registered user Profile.
8. You must not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with Jampaq, a Jampaq software application, produce, or service, including, but not limited to, the Service.
9. You must not create or submit unwanted or non-solicited email to any Jampaq Network members ("Spam").
10. You must not transmit any worms or viruses or executable code of any kind over the Service.
11. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright and trademark laws).

Violation of any of these agreements will result in the termination of your Jampaq Network account. While Jampaq prohibits such conduct and content on the Service, you understand and agree that Jampaq cannot be responsible for the Content posted on its network and you nonetheless may be exposed to such materials and that you use the Service at your own risk.


General Conditions

1. We reserve the right to modify or terminate the Service for any reason, without notice at any time.
2. We reserve the right to alter, update, revise, supplement, and otherwise modify these Terms of Use at any time, and to impose new or additional rules, policies, terms, or conditions on your use of the Service. If the alterations constitute a material change to the Terms of Use, Jampaq will notify you by sending an email message to the email address listed in your Jampaq Network Account contact information, a notification that appears in a Jampaq application, or by a posting on the Jampaq dot com website. Notices shall become effective immediately. What constitutes a "material change" will be determined at our sole discretion. Such updates, revisions, supplements, modifications, and additional rules, policies, terms, and conditions (collectively referred to in this Agreement as "Additional Terms") will be effective immediately and incorporated into this Agreement. Your continued use of the Service following will be deemed to constitute your acceptance of any and all such Additional Terms. All Additional Terms are hereby incorporated into this Agreement by this reference.
3. We reserve the right, in accordance with any applicable laws, to refuse service to anyone for any reason at any time.
4. We may at our sole discretion, but have no obligation to, remove Content and accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable, which content may or may not be identified as having explicit language, or violates any party's intellectual property or these Terms of Use. Nevertheless, you agree to use the Service at your sole risk and that Jampaq shall have no liability to you for content that may be found to be offensive, indecent, or objectionable.
5. We reserve the right to change your username where we determine, in our sole discretion, that another business or individual holds legal claim or trademark to the username previously specified.
6. We reserve the right to suspend or remove accounts where we determine, in our sole discretion, that they have been created in such a manner as to be abusive of or disruptive to the Service, such as, but not limited to, mass or serial account creation, accounts created to sell to others, or user name squatting.
7. Waiver and Indemnity. By using the Service, you agree to indemnify and hold Jampaq, its directors, officers, employees, affiliates, agents, contractors, and licensors harmless with respect to any claims arising out of your breach of this agreement, your use of the service, or any action taken by Jampaq as part of its investigation of a suspected violation of this agreement or as a result of its finding or decision that a violation of this agreement has occurred. This means that you cannot sue or recover any damages from Jampaq, its directors, officers, employees, affiliates, agents, contractors, and licensors as a result of its decision to remove or refuse to process any information or content, to warn you, to suspend or terminate your access to the service, or to take any other action during the investigation of a suspected violation or as a result of Jampaq�s conclusion that a violation of this agreement has occurred. This waiver and indemnity provision applies to all violations described in or contemplated by this agreement.

Copyright (You Own Your Own Content)

We claim no intellectual property rights over the material you provide to the Service. Your profile and materials uploaded remain yours. You can remove your profile at any time by deleting your account. This will also remove any text and images you have uploaded to the Service. Jampaq undertakes to obey all relevant copyright laws. We will review all claims of copyright infringement received and remove content deemed to have been posted or distributed in violation of any such laws. To make a claim, please provide us with the following:

1. A physical or electronic signature of the copyright owner or the person authorized to act on its behalf;
2. A description of the copyrighted work claimed to have been infringed;
3. A description of the infringing material and information reasonably sufficient to permit Jampaq to locate the material;
4. Your contact information, including your address, telephone number, and email;
5. A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
6. A statement that the information in the notification is accurate, and, under the pains and penalties of perjury, that you are authorized to act on behalf of the copyright owner.

Claims can be sent emailed to copyright@jampaq.com or sent to Jampaq, Inc., 1059 Alameda de la Pulgas, Belmont, CA 94002. Contact the agent designated to receive and act on copyright violations under the Digital Millennium Copyright Act (DMCA).


Jampaq Unsolicited Idea Submission Policy

Jampaq or any of its employees do not accept or consider unsolicited ideas, including ideas for new advertising or sponsorship campaigns, new promotions, new or improved products, services or technologies, product or service enhancements, processes, materials, marketing plans or new product or service names. Please do not submit any unsolicited ideas, original creative artwork, suggestions or other works ("submissions") in any form to Jampaq or any of its employees. The sole purpose of this policy is to avoid potential misunderstandings or disputes when Jampaq products or marketing strategies might seem similar to ideas submitted to Jampaq. If, despite our request that you not send us your ideas, you still submit them, then regardless of what your letter says, the following terms shall apply to your submissions.


Terms of Idea Submission

You agree that: (1) your submissions and their contents, including, but not limited to, any suggestions, enhancement requests, recommendations or other feedback, will automatically become the property of Jampaq, without any compensation to you; (2) Jampaq shall have a royalty-free, worldwide, transferable, sublicenseable, irrevocable, perpetual license to use or redistribute the submissions and their contents for any purpose and in any way, including, but not limited to incorporation into the Jampaq Network or any Jampaq application, software, product, or service; (3) there is no obligation for Jampaq to review the submission; and (4) there is no obligation to keep any submissions confidential.


Jampaq Feedback and Comments Policy

Jampaq values your feedback regarding our products and services. If you want to send us your feedback, and we hope you do, we simply request that you email us at feedback@jampaq.com. Please provide only specific feedback on Jampaq's existing products or services; do not include any ideas that the Jampaq policy will not permit it to accept or consider. Any feedback you provide at this site shall be deemed to be non-confidential. Jampaq shall be free to use such information on an unrestricted basis.
